The article is wrong about that. Look at japanese
website : if they have so few pictures, that's
because copyright holders are very concerned.
Also, people who wrote that article forgot a few
things : In the case of FY, it's not because the
author didn't said anything that it automaticaly
mean it's allowed. For all that matter, the author
is probably not the main person concerned :
Copyright for things like anime belong mainly to
the studio and a couple other companies.
Also, they totaly ignore the fact that there is
several copyright holders usualy : It's not
because the holder in Japan doesn't feel concerned
that the company holding the right for USA won't
be.
The situation resumes itself to : It's illegal but
somethings may be tolerated. It's not granted and
as all things tolerated, if there is too many
abuses, the attitude of copyright holders may
change.
Also, the situation is very different for cels :
when doing a forgery, it's not just the copyright
that is involved. In fact, most of the discussion
about copyright is pointless in the case we are
speaking about : either the fancel is different
enough from a production cel and nobody will feel
bad that you copied his cel. Or it's a copy good
enough to annoy the owner of the original cel and
in this case, it's a forgery.
And to come back to how we "feel" about such
things... Well, it's useless to "feel" : obviously
some so-called "fan artist" don't give a damn
about politeness, ethic, intellectual prioriety
and others people feeling. Telling them how we "
feel" about it won't change anything. That's why
you directly speak about legal matters to them.
In this industry, many companies have the same
kind of behaviour : they may set some rules and
guidlines about how fan can use their copyrighted
material and may let people do what they want as
long as they "feel" it's ok. But if there is too
much abuses, they will speak about laws. Then it
won't matter that only some people abuse : it will
affect everybody. As I already mentioned, it
happened many times with fansub groups : Some
companies didn't mind it as long as there wasn't
too many abuses. But when the situation degraded,
they simply |
