Actualy it already happened a couple of times.
Also, if a lawyer was offering to sue the so
called artist in exchange of a % of what would
be gained, many companies would accept. In fact,
there is companies whose only job is to look for
copyright violation and offer to enforce the
copyright's holder rights in exchange of a part
of the gain...

Because someone, at one time, may try to sell the
forgery to an unsuspecting person as if it was an
original ?
Because if you want to sell your original and
there is a couple copies around, you may have more
problems persuading buyers that yours is the
original...
