Most Japanese companies turn a blind eye towards the Doujinshi industry.
To them, fan comics etc are free publicity. The laws over there are almost as anal as the laws over here, but they
have a huge fan industry, we in the USA don't.
Still, there are cases of fans who get smacked with a lawsuit. For example, the Tokimeki Memorial creator went on a rampage against pornographic doujinshi of Shiori Fujisaki since he modeled the character off his own daughter. I doubt that stopped the production of H doujin of Shiori, but it was probably a shock to fans.
Also, fans that start making way too much money get hunted down.
However, fan art getting passed off as official is another matter....
