Judging by what you have said in your post, it
seems to be BOTH parties' faults.
1). The company made a technical error with the
pictures and sent you the cel of the enlarged
picture, which is the supposedly "correct" cel you
ordered according to their records and their cel
ID labels (if you know what I mean). So, the
company made an error which is pretty common on
websites. The company is very irresponsible to
ignore your e-mails or keep on trying to "delay"
as you put it.
2). You as the buyer, did not clearly state WHICH
cel you wanted which caused the company to get
mixed up as to which cels you wanted. As a buyer,
I ALWAYS give a link to the picture of the cel I
want whenever I place an order. This clears any
loose ends up. It would not be good to ask for
compensation for a miscommunication.
Now that we have these things out in the open . .
I don't think they are intentionally trying to be
fraudulent or scam artists. This defintiely looks
like a miscommunication between seller and buyer
and the company doesn't like to take
responsibility for this since they probably think
it is your fault and not theirs.
So, what I suggest you do is:
1). Contact a 3rd party organization like Square
Trade to try and resolve this issue. You should
request a refund for the cel.
2). Just move on. When it is this long (9-10
months), there is really nothing more a person can
do about it. Sometimes the best thing to do is
just move on and learn from the incident.
