Of course he/she has the right to charge 
whatever they want for a cell they sell, no 
matter whether they are quickly reselling it or 
not. Is it good business practice? no... but they 
still have that right.

and everyone else has the right not to buy 
from them at an inflated price. Or they have the 
right to say "well... even though its inflated, I'm 
still interested".

You're off base here, noone was saying that it 
wasn't his/her right to resell the cel.
