Also, you could also get them for mail fraud.  I 
have a friend that paid for an item on an auction 
and never received what she paid for.  She went 
to the post office and filled out paperwork for 
mail fraud.  $40 may not be a big amount BUT it's 
still fraud and that is a federal crime.  She was 
sucessful in getting her money back, after filing 
charges!
