I agree on the fact that if she paid you
$1000.00 you could (and probably should) send
her the thousand dollar cel that she is
requesting...and keep the others to sell later
at your discretion.
If you choose to do that, I also think that you
should refund her the rest of her money the
$184.00 (minus the shipping costs of the cel
because thats reasonable)
another option is to let her choose whether she
wants the combination of two cels as long as it
totals up to the $1184.00 she gave you. She
should choose whether or not she wants this, you
shouldn't decide for her on your own. If it gets
legal you could be in a jam. Even though you
wanted to sell all three together, if she asks
you now for one cel in particular your options
are:
Yes, and send the cel. (minus shipping)
No, keep the cels and refund all of her money.
You cant legally decide what a customer buys
without stating somewhere in the contract that
you can make subsitutions at any time.
If I send 500.00 for cel A and someone sends me
cel B instead, I would sue for my money back.
as for the keep 10% idea...
If you didn't have a written contract, (Emails
etc that states she will have to pay
a "restocking fee" or a "kill fee") its not
binding as she didn't know about it before the
sale and was unable to take it into
consideration before her purchase.
Every store in the world has their restocking
policies where the customer can read it.
If you sold them "as a lot only and you
wouldn't break up the set" then its totally up
to you whether you want to part with her money
and keep the set. Or break them up and let one
go for what she paid for it. The only things you
cant do is keep the money and give her nothing,
or keep her money and give her what she DOESN'T
want.
Whether or not you like this person is beside
the point. I HATE my college loan people, I
still have to pay them.
