You can claim the money back, but you will have
to do it through the Credit Card company (I can't
imagine Pay Pal will be much help). There are
basically two approaches you can take.
1. Claim that the payment wasn't made by you,
simply ask your bank what the payment was and
query it stating that you never made the payment
(or at least you don't think you did). This
forces the Cred Card company to query the
merchant (be that Pay Pal or the third party) who
then must produce evidence (generally a receipt)
showing that you did make the payment (generally
within a fixed time period of about 6wks,
depending on the CC company) if they fail to
produce the evidence that it was your payment
then they must refund the money.
2. If they do show that it was your payment then
the next step is to state that the payment was
made for goods which were never delivered, hence
it was fraud. Again they go to the company making
the claim and ask for proof (and around we
go ...). If they fail to prove they delivered the
product they must refund the money of face being
cut off (actually the CC company pays you and
then goes after them).
Its kind of strange, and something that isn't
widely advertised, but you are reasonably
protected using a Cred Card. However you may get
stuck as "Drac" (I think) pointed out that it was
PayPal making the transaction and not the third
party (but its worth a try).
A final note, think of all the "over the phone"
transactions people make which can later never
prove to be made by the shop.....IMHO it leaves
this wide open to abuse....
Oh a final note, they generally like you to make
an effort in resolving it yourself before the CC
company steps in (and they may charge a fee
depending on the company).
