I sent a check to someone for a cel at the 
beginning of January.  He cashed it and promised 
to send the cel, and I didn't hear from him for a 
month- no cel arrived. I sent a registered letter 
demanding he send me the cel or a refund, and got 
the receipt for the letter. I finally heard back 
from him and he said he was in the hospital.  
Okay fine.  Again asked him to send the cel, he 
said he would within a couple of weeks.  Still 
nothing.  I asked for a refund as his latest 
excuse was that the cel was at a different 
geographical location.  Again, he said he would, 
and still nothing.
I am planning to file a suit against him in small 
claims court, and he is in the U.S.  I need to 
know whether I can file this in my county or if I 
have to file it in his?
