well, here's the sitch:
buying on ebay is always a risk, but it's your
choice to take that risk to get great merchandise
for cheap prices. hopefully the dealer will be
sympathetic and take the cel back, but if not,
there's not much you can do. you can leave
negative feedback if you wish, but that can
result in you getting negative feedback from the
seller. I've been screwed before and have since
learned that sometimes letting it go is the best
thing to do, unless of course you paid hundreds
of dollars for something(which in your case you
did not).
