I wouldn't have known unless I actually checked out the screen name.  I think you should let this person know that it is VERY apparent that he copied your HTML.  

Although you can't really "copywright" HTML, the words you use to describe your auctions and terms are your own. Perhaps you should ask him to maybe add-on a disclaimer that he is in no way affiliated with you or your auctions.  

(btw: I know you are a great seller coz I bought my first cel EVER from you.)
